
Dear Bristol Bay supporters,
From the minute that the key federal permit was denied in November 2020, we knew that the Pebble Limited Partnership would continue to push its mine plan in Bristol Bay. They promised to try to overturn the permit decision, and officially filed an administrative appeal in January 2021.

While watching the process with an eagle’s eye, we also saw Governor Mike Dunleavy and the State of Alaska attempt to file an appeal. But the regulations are clear and the State doesn’t meet the qualifications to be an appellant. Therefore, the Army Corps of Engineers denied the State’s request for appeal review on February 26, 2021.
Appeal request
The Army Corps of Engineers found Pebble’s appeal request to be timely and could be considered. It will undergo review over the next 90(+) days. If the appeal is denied, the permit denial will be final. Pebble’s only remaining option will be to sue the Corps. If the appeal is granted, the Corps will reverse its decision and may grant Pebble a permit. Interested parties like Trout Unlimited and the State of Alaska could intervene at that point.

Pebble’s attempt to overturn the permit decision is a sound reminder that our work is far from over. It will continue to try to develop in Bristol Bay until there are permanent legal protections in place. Tell your elected officials to support permanent protections for Bristol Bay today.
We will keep you updated on the status of the appeal process, but in the meantime, please take a minute to tell your members of Congress to support permanent safeguards for the region.
